This is a strictly "legaleeze" issue. If the employee was treated unfairly or discriminated against in some way, of course he has the right under U.S. law to sur his/her employer. But neither the employer or the employee wants to go this route. The employer can then be charged not only with unfair employment practices, but be charged with hiring undocumented citizens as well. The dummy employee who stands up in court to charge his employer with discrimination will be back trying to snag sharks off the beach of Desemboque, Sonora by sunup tomorrow.

Here in Arizona we have a law that requires that you have a license to sell marijuana or other drugs. People have actually applied for this license. Granted, some have done it as a joke, but if you are ever caught selling drugs without a license, the penalty doubles. Us people are something else, huh?

Good subject. Good question.

The Judge was clearly following the law to the letter. In most states the treatment of workers by employers is governed by a Labor Code. Other laws do not apply. It is the fair treatment of workers the law seeks to ensure and this is the case regardless of their immigration status. If you think about it, this makes perfect sense: the law protects all workers hired by employers. If the employer chooses to hire undocumented workers he cannot be allowed to use that choice as a shield.

As far as illegals suing, "our" government values the pawns being used to dispossess us from our country (and make peasants of us) more than it does us citizens. (Remember during the '60's people preaching Malthusian doom came around preaching birth control? Well, now industry is crying for workers, and since Americans were scared by the Chicken Littles from producing more population, we are getting our population mostly through immigration, mostly illegal. So, the population growth is not from the American middle class, but from tractable illegal aliens.)
AMERICANS---"your" government doesn't want you! You are in the way!

That can't possibly be right. It is illegal to knowingly employ them. The judge can't order the employer to break the law.

He can order them back benefits, say, for the period they did work, if they were defrauded of them, but he can't order illegals back to work.

That has got to be wrong, somehow.
