The system is out of order ! I am a farther and I find it rude and not fair for just the mothers to be looked at as the custodial parent only. Why is it that as a farther I am put in the garbage; I have to sign for rights or set in a motion to file for custody to obtain any right; While the mother can move out of state and not say a thing to the farther.

This is truly an unfair idea borne out of tradition. It is traditionally thought that a woman is a better parent then a father. . .that she is more capable to care for the child then a man. I find this irritating. In this day an age, if a woman is just as good as a man then a man should be just as good as a woman. Both parents should be judged on their ability to care for the child and the more capable parent be given custody. It is a shame. More children are hurt this way.

It is because she gave birth to the baby and carried it for nine months. And actually if you were married to the mother and then divorced she can not just move out of the state with out saying something to the father. But if you wanted to up and leave you could. But if you were never married to the mother and the child was out of wedlock, then the father does not have any rights till he ask and say I am the father. Why, because the child was not born to a "family" it was born to a "Mother".

You need a better lawyer.....but there are many things that are taken into consideration when awarding a parent custody. What the parent thinks is fair may not be in the best interest of the child. The child always always comes first.

I think its biased and unfair. You need to get a lawyer and get some rights. I think some fathers make better custodial parents than some women. Stick up for yourself...and fight for your rights to raise your children. I don't think that the mother can legally leave the state without the fathers consent

Well... I just wanted to say... perhaps its because the word is not "farther" its "father". But, its because the woman carries the baby so *usually* (not ALWAYS) she has a closer connection to the child. Plus, a lot of dads now days are dead beats.
But, if the mother is a sucky mother then the father should DEFINITLY get the child (if he is a good father).

I don't know what state your in that your kids and move if you have a open case in the Friend of the court. She can not move out of the state with out yours and/or judges permission and if she does then she has the chance to lose the kids all together.

My ex was abusive to me and threatened my son, taught our 5 yr old son about sex and many other things and I still can't do nothing to get visitation supervised or stopped all together. If i don't send him on the schedule visits i can go to jail for contempt of court.

Really feel that they are taking his side in the matter in my case and my arms are tied until if am done with school (hopefully in a yr) when i can afford a good lawyer to fight for mine and my sons rights.

It's just traditional thinking. The same thinking that says women can kill their children and get away with it because of PTSD and PMS and every excuse possible but when a man so much as backhands a child when the child deserves it he is thought to deserve life in prison.

Its really old fashioned and some what bias if you ask me...
But at the same token women carry the children etc...so I guess one would assume that the mother is naturally going to be the better care giver...which we know is not at all completely true...Anyone hear about the woman who shot her 12 yr old son on Monday?....Crazy isn't it?....

The judicial system will never side with the male in no case unless its extreme man , your ex wife can be a street hooker and still have more rights than you when it comes to raising your kids.
