Is insulting or talking back to a cop considered assault on a police officer? I know they can pretty much call anything they want disorderly conduct but thats only a misdemeanor and assault is a felony.

I'm a police Officer from Ohio, i don't know how much you know about the law, but here it is. In all states, you can talk back to a cop(use swear words, pig, the finger, etc) it is not disorderly conduct. (no crime) because of case law decide in the United States Supreme Court. "A police Officer can not be offended" However I will tell you that in a real life experience if you talk back to a cop, he, she is less likely to give u a "break" or other consideration. In my dept. if someone wants to talk back that is fine, but then don't expect me to give u a break or a warning because i don't have to. U might say this is not fair, well life in not fair.
Now if you threatened harm or death or attempt or cause harm(assault) actually trying to hurt a police Officer you will be committing a serious crime. and most states make it felony to assault a Police Officer, fireman, or EMS workers. Menacing is where u use words to threatened harm to a cop and that is a crime as well. It is always best to treat the Police with respect and they will treat u with same
