Actually Jewish tradition had women that commit adultery OR fornicated out of wedlock stoned to death. When Joseph learned about Mary's condition since he was a good man that didn't want to see this woman killed (although se wasn't carrying his child) he went along with the story.

They weren't married yet. Matthew 1:18 But the birth of Jesus Christ was in this way. During the time his mother Mary was promised in marriage to Joseph, she was found to be pregnant by holy spirit before they were united.
She was PROMISED IN MARRIAGE to Joseph. At that time, a woman and a man would only be considered married if the man "took his wife home" which is what Joseph did according to Matthew 1:24 Then Joseph woke up from his sleep and did as the angel of Jehovah had directed him, and he took his wife home.
They did not have intercourse until Jesus Christ was born. This is a fact that really startles all of Christendom. They view Mary as forever-virgin woman, where the Bible clearly states that she had intercourse with her husband Joseph. Here it is, in Matthew 1:25 But he had no intercourse with her until she gave birth to a son; and he called his name Jesus.

Mary was pregnant with Jesus before she was married to Joseph. For that reason, Joseph wanted to break off the engagement but the angel of the Lord told him to not be afraid to take Mary as his wife. There's nothing to suggest that Joseph and Mary didn't "do it" on their wedding night.

Marry and Joseph were not married until after Mary conceived.

Joseph was troubled in his heart because he knew that she would not be accepted socially,
Matt 1:19; Because Joseph her husband was a righteous man and did not want to expose her to public disgrace, he had in mind to divorce her quietly. (In those days, once you were betrothed, you were considered to be together and if you had to separate, it would have still been considered a divorce)
but he loved her. An angel appeared to Joseph in a dream and told him:
Matt 1:20: "Joseph son of David, do not be afraid to take Mary home as your wife, because what is conceived in her is from the Holy Spirit.

They were not married..they were betrothed which is almost the same thing except they haven't come to live together or consumate the marriage. Mostly it what happens when the bride is not yet ready for marriage because of her age. It wasn't just Mary's virginity that was the cause of her being chosen..it was also because she was a direct decendant of King David and as well her heart was with God. Read the Gospel of Luke (the only gospel that contains the Hellenistic "virgin birth" narrative) again.
Mary was not yet married when she became pregnant with Jesus. She is the "unmarried mother" so condemned by Catholic and Protestant pedants today! In fact, part of the quiet heroism of Joseph as portrayed by the very humanistic Luke is that he took as a wife this pregnant woman, whose simple virtue he accepted despite the fact that by the conventions of Roman Judaea in the reign of Tiberius, this would have entailed a significant loss of face for Joseph himself.
Jesus' brother James and his other siblings are the "natural" children of Joseph and Mary as a married couple.

Back in the day, when a man and a woman were engaged, they pretty much were married, because the engagement could only be stopped through divorce.

When Joseph married Mary, she was ALREADY pregnant with Jesus. Joseph found out and he was about to divorce her but God sent a message when he slept and told him that the boy was the son of God, MAGICALLY pregnanted by him. So in reality, Mary is still a virgin.

Both Mary and Joseph had taken vows of Chastity before they were married. The prophets knew that Jesus would be born in the "house" of David. When Mary was born she had a birthmark on her abdomen that signified she would be the woman chosen to be the mother of Christ. She, however did not know this (that she would be the mother of The Christ). She entered the temple as a very young child and took a vow of chasity. When she was marrying age, she was told that she would have to marry. Joseph was chosen for her husband because a lily bloomed on his staff when he was lined up in the temple with "other" bachelors. This is why you see him in statues and paintings holding a lily. Anyway he had also taken a vow of chasity. Neither wanted to be married, but they had no choice. So, they married and agreed to live as brother and sister because both had given themselves to God.
In those days people were very serious about being virgins. Both the pagans and the Jews. Remember that even the pagans had their temple virgins. It was considered very awesome to a Virgin.
