I am a secretary for a divorce and custody attorney, and 99% of the time the mother is awarded sole physical custody and the mother and father are awarded joint legal custody. But in this case it would be tough i would award sole physical to the father.

In most cases the mother seems to always get custody. But if the father wants custody of the child, has a good lawyer, he may have a good chance too. I don't understand how the mother could go for a whole week without checking on her child. I'd consider that abandonment.

Child custody cases are not solely based on if someone calls to check up on the child. It is looking for the best interest of the child. Most judges want to favor the mother, but if the father is a good person and has a good head on his shoulder then it will be hard for the mother to retain custody. More than likely if the mother is not a drug addict or child abuser she will not lose her child. The more likely outcome is shared custody or joint custody. Equal time for both parents. Pull the laws of child custody for your state, it is an eye opener.

My dad raised me but the courts awarded him no child support because he's male. The courts don't like men to much. I say be fair children need Mommies and Daddies especially one;s that want to be there. Don't let our justice system take that from your child. Two it's not about winning and losing, if you look at it that way your child may lose out on something important in the long run. I know I did growing up with out my mom after I tunred 8 was tough. So regardless to how your feeling towards him don't try to use the child to burn him ok. The situation you've described sounds decent.

My husband was married and had a child and was divorced(before we got together). He gained custody from the very beginning and has had it ever since. Although he is and always has been a wonderful father, the only reason that he got custody is because his ex-wife did not even show up at court for custody. Men truly get screwed over in custody cases. Sad and unfair, but true.

A women wins custody up until the point she is unfit.
No body in the system gives a rats *** about responsibility or the children for that matter. It cares about giving mommys what they want.
So to answer your question, a selfish irresponsible (but not unfit), mom that cannot support a child will win custody over a responsible giving man that can support the child.
Then we can take dad's money and the taxpayers money to support the irresponsible mom.

It depends on who is a more fit parent. If the mother does drugs, then hopefully to courts will give custody to the father. Or if one parent does not show up at all for the hearing, then the parent that does show will receive the child, ( as in the case with my parents).

in most cases it does not matter how bad of a person the mother is she still has her rights to a baby, and the court does not like to seperate mother and child...they would rather give the child to the mother even if the father is a saint...My best friends bf is going through a custody battle with his babys mama and she is a coke head and she gets him every time...she lives in an outpatient rehab center and she has custody not him...he owns his own business and has his own house and a new truck...she still gets him.....

If the mother can be proving to be a fit mother she will get custody (judges always go 4 the mother)
Does the baby have the fathers last name???
If not then u dont have to worry Baby is automatically with the mother
