If I am out driving around and I snap a photo of someone's property and I want to be able to sell the photo...do I need that property owner's permission?

Anything unique will need a property release. Any photo taken of privately owned property may need and should have a property release for any images used for commercial use. Commercial use in this case does not include artwork, such as framed prints, or editorial use such as a magazine article. It does, however, include advertisements and promotions.

This is a very gray area within the law. You may think that this is just a ordinary house but if it turns out to be the home of somebody natorious in anyway selling the pic could cause you problems even years down the road. /www.danheller.com/bizfaq.html

Only if you triing to sell there property, not the photo thats yours

No, you don't.

However, if you would like to give off a good reputation, you may want to get the permission from the owner's first. Again, this isn't neccessary though.
