Living in Texas. Have a credit collector threating to garnish my wages (not alot) and my bank account (nothing left after paying bills). If I had the money for bankruptcy or a lawyer I wouldn't need this ad. There has been no legal action yet (isn't this civil) but I have been told they can get a legal lien or judgement. The collector claim all kinds of action. I don't own anything and owe everything. I got behind on my bills last year due to many personal issues and when you are behind on a credit card they make it impossible to make it up!! Can they garnish my wages???? If they could garnish my bank account I would just close it. Not trying to skirt my responsibility but I can not pay this debt - even though I understand I did incurr it. I had to just borrow money for my sons (26 yr.) funeral. A plain, basic funeral today is over $9 thousand !! Please help me

How much debt are we talking about here? It's not worth filing bankruptcy for a small amount (under 10k).

Maybe this will help you out. In Texas, wages are exempt from garnishment. So unless you have a bank account they can't touch you. They can go after any state tax refund you have. They can still place a lien against property. They will certainly take you to court so they can get a judgement aganst you, which will kill your credit score. But if you don't have the money to pay the bill, what else can you do?

I suggest you just send the collector a letter. Use the sample below for an template.

Include the following:

Demand that they "validate" the debt.

Tell them to Cease and Desist all communications with you, except for the validation information you are demanding. That means no phone calls or letters.

Remind them that Texas exempts wages, and that you have no property or bank accounts. Basically, you are "judgement proof" and if they wish to waste money on a lawsuit that they will never be able to collect on, go for it.

Yes they can garnish your wages. However, the Consumer Credit Protection Act says, that you have to take home 30 time the minimum wage per week. Garnishment can take 25% of your net wages, but no matter what you have to take home 309 Dollars a week. Anything over that is subject to the 25%.
Go see a lawyer that advertises for Chapter 13, they will add the fee into your repayment.
So sorry you have to deal with this on top of everything else.

Try the Consumer Credit Counseling Service. They may be able to help you negotiate these debts w/o a bankruptcy. Do that only as a last resort. It will cost you money, and lots of lawyers can make it worse.

i had the same problem. my wages were garnished for over 2 years. there are lawyers out there that take payments for bankruptcy. i went bankrupt last year, i'm only 27. it sucks but it was for the best. good luck and sorry about your son :(

Could you pay $17 a month to have your own attorney? Would being able to call a real attorney and ask them this question be valuable to you?
