Wow, some people answering this question have some real anger issues. Actually I used to be against kids having cell phones, but on more than one occasion cell phones have been used to foil abductions, and to let people know if i child is in a dangerous situation. I think they are a good thing to let kids have to be able to contact them should an emergency situation arise, or to simply know where they are.
You should be commended for being able to keep a cell phone in good working order for 4 years. Your parents should see that responsible act, and allow you to upgrade to a newer model. What your folks should have done is get you the new phone, and let your brother use the older phone for a while to see if he can properly take care of it just like you did for four years. If he proves he tan take care of the older phone, then he should be allowed to upgrade to a nicer model. That's my opinion, I could be wrong, but that is what I would do.

If you both deserve to have cell phones, then it's fair. It's really not possible for parents to keep everything perfectly equal between children, so they have to decide what's "fair" for each person in a separate way. If you look at things it from their perspective, things will make a lot more sense... and you'll be able to get what you deserve more of the time. Here's a piece of advice that I think is worth remembering as you go through life. Don't compare yourself to others too much. It will either make you smug or disappointed. Think about what YOU deserve and what YOU'VE earned based on your own behavior and attitude. That's the best way to know whether life is being fair to you.

Life does not always seem fair...however in this case...I would have upgraded your phone at the same time as getting your brother his phone...By keeping the same phone for 4 years you have shown you are a very responsible young adult...talk to your parents...most cell companies do offer free upgrades when you have had the phone for more than 6 months
good luck and try smiling :)

I hate to say it, but my parents would never have gotten me a cell phone. I once got a pager for work when I was 16. I paid for the pager, the service, and it was for my job. My father saw it and took it. I had to give him a PowerPoint presentation on why I needed it for him to give it back to me. You are spoiled, life isn't fair. When you get laid off from your job right after you bought that car or house it will not be fair. When you fall in love with that perfect guy/girl and they leave you for another, it isn't fair. When you get a medical condition that 1 in 5 million people have and you will have hideous skin or you will die before age 30, that isn't fair. Sorry kid, all of these are possibilities and there's nothing you can do about it. Life isn't fair. Deal with it.

What the hell does a 9 yr old need with a cell phone? Why would you need one too? Sounds like you are both spoiled little brats. Get a job and buy a new one.

I'll tell you what's fair. You going out and getting a job and buying yourself a brand new phone you spoiled brat. He got a new one because it's his first phone. I'm sure in 4 years he'll still have it. Deal with your phone and stop trying to be a trendy little spoiled brat. Go get a job if you don't like it.

Was yours new four years ago? If so, I would say that it is fair. Also, at 16 you could work and save up for a new phone.

Yes it is. Be grateful you HAVE a cell phone. Your phone was probably new when you got it. Stop complaining and being ungrateful.
