I would make sure that the marriage is truly unfixable before deciding on a divorce. You may have the potential for a nasty fight over the kids in your case.
He cannot just take the kids unless that is what you want. Custody matters are settled during the divorce.

has the hubby hit you or done anything that can be considered abuse if he has you take the kids and file on grounds of abuse he probably only wants one kid so he wont have to pay support you say he works allot how is he going to take care of a child when he is not their in most states the parent who has the kids when divorce is filled keeps the kids till the divorce or custody is established in most states the mother is given custody unless their are things in her past

Get a good lawyer and prove the kids will be better with you. But I would see what your kids want... it is very easy to overlook what really matters in the midst of a divorce.

As you can see, he is only arm twisting you, if he was a strong man, he would never do it anyways.
The courts usually favours a mother who can support her children both financially and emotionally since you can do both, your victory is guaranteed.
But make sure your kids don’t stop loving their father just because you have. He will always be father for them, and that remains unchanged, so don’t let your personal bitterness ever touch them as they would be more hurt and damaged by that rather than the actual divorce.

sounds like he is using the kids to threaten you and scare you outta getting a divorce , -id seek free legal advice and id also like to say that never stay in a bad relationship for the sake of the kids - good luck to ya whatever you decide

The court usually give joint custody with one parent as the primary custodian. It is very rare to separate children from their siblings. Get a good lawyer and hold on for a long ride. I wish you the best.

All you can do is get a lawyer, tell him what you want and fight for your kids. Could be, your husband is only trying to make you stay and when push comes to shove he will let the kids be with you without a fight.

i'm sorry tht u r divorcing. if u want divorce n he wants one kid,he may get it. depends on how old kid is. if he n she r below 8 then,mum gets custody unless mum is a drunk,hooker etc..
if dad took custody, n he's so busy, apply to court to grant u cusody/vary d order earlier,cite reasons. c ur social welfare officer 4 help.
