Unpaid Judgements?

Question

I have to unpaid judgements from a bad divorce. One is private from a individual in small claims court, and one is from an apartment complex I was living at at the time of the divorce. Both of the Judgements are from New Mexico. How long will they be there, and How do I get them off?

According to § 605 of the Fair Credit Reporting Act [15 U.S.C. §1681c],

No consumer reporting agency may make any consumer report containing any of the following items of information:

(1) Cases under title 11 [United States Code] or under the Bankruptcy Act that, from the date of entry of the order for relief or the date of adjudication, as the case may be, antedate the [credit] report by more than 10 years.

(2) Civil suits, civil judgments, and records of arrest that from date of entry, antedate the [credit] report by more than seven years or until the governing statute of limitations has expired, whichever is the longer period.

So, it is SEVEN years.

These judgments won't come off your credit report until the seven year period has passed. You can pay them off as a sign of good faith and credtiworthiness, so when you apply for credit (including mortgage) between the date of payment and the date of expiration (when it falls off the report), you will have resolved these outstanding debts.

If you do pay them -- these judgments will show on your credit report as paid and will expire seven years from the date the items were negatively reported on your credit report.
