I'm still technically married, but there is a 5 yr order of protection(complete stay away) and we are hoping to file for a divorce here, but I found out he was in jail the past week and his mother will not tell me for what, is it possible I can find out? even if there's an order of protection? I want to know for family court, we have 1 child together. He got a class E Felony last August, the judge said 1 more f*** up and he's looking at prison time, but that was a yr ago, I'm assuming this time it's bad also, since she won't tell me what the charge is, so is he also looking at prison time because of what the judge said? The mother in law said he told her it looked like it was bad, she said he could be in there till his daughter is 18, although she always thinks the worst. So can I find out the charge even though there is an order of protection and w/ what the judge said 1 yr ago, do you thinkl he's looking @ prison?

Arrests are a matter of public record so you should be able to find out the charge by contacting the District Attorney's office. Or if he is supposed to be paying child support, or if you want to file for it, they should be able to tell you what he's in jail for. Also, if he's still on probation from his last offense, this new arrest would have violated the original probation. So he could be looking at a probation violation in addition to whatever the new charge is. The length of time he might do depends on how serious the new charge is and if the probation was violated. Just don't contact him because you might get in trouble for violating the protection order. Good luck.

Most newspapers list arrest and charges. If you know the approx date, you might look there. Be especially easy if they have a website.

Plus, you might try the court docket, that is public record. Also, since protection order you may be able to call and ask the jail, they may or may not tell you why but should tell you that he is indeed in there.

As to time, that really depends on judge. The judge can accept or reject plea aggreaments. So, he can control that. But prosecutors bring charges. Unless he was on probation, in which case the judge can revoke because of new charges. Regardless of outcome.

Talk to your lawyer. They will be able to petition the DA for the information. But you can find out from the freedom of information act. Basically, all court cases (unless sealed) are open for public review. But a lawyer will be able to get the real dirt.

those records usually dont becone public until after the conviction, you might be able to find the charges by just calling the jail, or you can get your divorce atty to call
