if no one answered before, no one will answer this time. why dont you just do some online research and figure it out yourself?

The laws are constantly changing right now as this is a very hot topic. His best bet is to wait but not get caught. If he has been here for over 12 months as an illegal if he leaves or gets kicked out he cannot return legally for 10 years. The marriage thing only works if the spouse of the American citizen is still outside of the US and they need a visa to be able to come over. This is all I got for you though. Sorry! Keep an eye out on the news. That is your best source of information.

Has the wife and him discussed this with a lawyer and I mean a real lawyer not these collect the money on Friday they barely do any work but still demand more money as it's getting closer and closer. I think they should do their home work and gather all the information about these lawyers. To many people who do it the inproper way,end up getting ripped off and, deceived all in the name you pay $$$ we give you better life . When in 90% of these cases put not much effort and time to stop flow of illegals. Do Mexicans have any morals at" all.When all mexicans steal SS# numbers assigned to other Americans are #used by Americans why is it o.k. to steal numbers their numbers and use these numbers furnish to America used by illeagls now get used to mexico citizens. Americans do you just get used to it now to illgals who still go to church and sign a hym rip off SS# during the week. All in all Amereicans get ripped off each and ever day ,days by days illegls who want a better life without a care whose life they destoryed to in order to get it.It's all about a better life. This is my story both humble an true. Tear it to pices and mend it with glue

BECOME LEGAL....us americans have to do it so what is wrong with him doing the right thing??? want to live in america but don't want to abide by the rules here....do what needs to be done legally and he will have no problems with marriage or children...

I say he just broke the law and goes to jail-he does not collect $200.00 and does not pass GO.
if he hurries back home he may not be noticed and can try to re-enter legally-ya think?
