My brother is the father who is a druggie living on the streets. He has been no part of anyones lives' for a year now. His ex girlfriend is the mother to my niece and nephew and has custody. Main points:
-Verbally, mentally, abuses them
-neglects all their health diagnosis, for she does not believe them
--calls her daughter; slut, wh%4e, etc
-Moves and constantly changes #'s in attempt to hide children from my family
-lies to them
-keeps them in home majority of time and now enrolled them to be homeschooled
-pins all her responsibilities on oldest daughter; caring for baby sister
-daughter threatened suicide and the mother went and got her a knife in which she sliced at her wrist in front of her and was then only sent her to her room
-nephew was diagnosed with ADHD and since mother does not believe it; refuses to get him help but punishes him for all related actions
-Has her daughter on a strict diet with her
-fixing up shed a little outside to have for son's room

Do you not have an organization like Children's Aid Society or CHild Protection Services? Call them and report her neglect.

depends on age of children. you can file for custody if the children want that, courts usually go with the wishes of the children after age of 13, if they are mature. sometimes when families get a hold of children, they pump them for information and the children overdramatize because it gets them attention and sympathy. if you are not being played, you could start by contacting a social worker and then filing a motion in court. Warning, it takes about 5,000 dollars. Be prepared. You had better be prepared to answer about your own faults, because you will be under a microscope.

If you can prove all that you have stated there should be no problem getting the children removed from the home. Whether or not they will be placed in your home or perhaps on of this woman's relatives is another story. The courts will decide that.

Sounds like if you can prove that they really are on drugs, etc. you could get custody right away.
Call and get advice from DCHS or Public defenders office. You might ask if anyone does "pro bono" work and get the case handled for free.

File for guardianship immediately and have those poor kids removed from the mom. You may also qualify for defacto parent status (this is someone who cares for the children as if a parent but aren't)
