The exact age will vary from state to state (and country to country), but IN GENERAL it is usually illegal for someone over 18 to have sex with someone under 18. In some states, if the younger person is under 14, the crime goes up significantly.

Having said that, these circumstances can be difficult to prosecute, particularly in the case (such as this) where the younger person -- considered by most laws to be the victim -- is looking to initiate sex. Consider for example two high-school seniors a few months apart in age; if the girl turns 18 first and has consensual sex with her 17-year-old boyfriend, he's most likely not going to press charges. However, if his parents hate her, and they can arrange to collect evidence proving that she did have sex with their son, she could be arrested and prosecuted in most states.
