I have lost a bet and a friend of mine is going to spank my bare *** in a very public place.
What i wasnt to know is, at what point would I be breaking the law? If i wear a thong, am I still committing indecent exposure?

Depends where you are. Here in the UK no one seems to mind too much if a girl gets spanked in public, and so long as you're wearing a thong I doubt it would count as indecent exposure. But I've been told that in parts of the USA both of you might get arrested, even if you were fully clothed and the spanking was obviously consensual.

Depends on the jurisdiction. Laws vary from state to state, county to county, and city to city. In most states the elements needed to constitute indecent exposure include the nudity as well as sexual gratification. Example; urinating beside a tree is not for sexual gratification, therefore would not constitute indecent exposure. One could argue that your spanking is for sexual gratification, but the burden of proof lies with the prosecutor. Again, even if your state's statute is more liberal than that, your local laws may be more strict. A city or county may enact laws that are more strict, but never less strict, than a state statute.
As for the answer posted about assault charges, in order for the act to constitute assault, there has to be a victim. If you are a willing participant agreeing to the spanking, you are not a victim.
Sounds like it's all in good fun. My only suggestion would be to not perform this act in the presence of children...or an officer!!! : )
Just remembered one other thing, there may be other violations you could be charged with. Disorderly Conduct is kind of a "catch all" in most jurisdictions. Someone witnessing the act would have to come forward as a victim though.

Usually, the statutes for "indecent exposure" apply only to lewd acts while naked. Simply being naked in public is not considered indecent exposure, although it could be a violation of some other less serious statute. "Lewd acts" are those that are sexually motivated or otherwise motivated by purient interest. So, if you are in your car naked, AND doing some stroking, in public view, then it is indecent exposure.

You would only be breaking the law (I presume!) if you didn't have a thong on and were completely pantless! However, as long as you don't do it outside a school or upset some old folks then I don't think the police would be too bothered! They may ask you to desist and cover up if you were making a right scene, but if you get a nice one they probably wouldn't arrest you anyway, just move you along! Take your punishment!

Allison, Wear a thong... Do it quickly and than leave.
tell him that you will do it, but as long as you are wearing a thong, you should not have an issue with Indecent Exposure.

Not for indecent exposure. But be careful - your friend could get it for assault if a cop witnesses the act. If they see it, they don't need anyone to file charges to go through with things. . .
P.S. - my husband wants to know if you're selling tickets to the event on ebay. . .

not sure if its breaking the law but i bared my butt once in the middle of a town centre wearing a thong and as i did a police car drove round the corner and stopped and said its a very nice butt, but can you please keep it in your trousers! i was so embarrassed i ran away.haha i think you should go for it but maybe the spanking will be considered a sexual act so not sure bout that bit.

You mean it OMG!....Do that when its night so that you are sure the cops may miss seeing it. It would tantamount to indecent exposure if the naked flesh of the *** upto the waist gets exposed.

unless you are at the beach, lake or pool, you could get a ticket or arrested for lewd conduct, if you are caught that is.
