my 18 year old daughter may be in trouble for check fraud because her father gave her a check when he was drunk and possibly under the influence of marijuana which he smokes on a regular basis and now he claims that he didnt give her the check to begin with.this is the same man who has given her numerous checks before.this particular check was for 950.00 and to top it off he didnt sign the check,but the bank cashed it anyway.so the police have questioned by daughter and have told her that she needs to either make suitable arrangements to her father or she will be prosecuted.i her mother have explained as much as i could to the police officers handling this case and they tell me that if i can get him recorded on tape admitting to giving her the check or at least saying that he doesnt remember giving her the check,then the police will just refer this case to civil court.so does anyone have any ideas or suggestions?if i had more characters then i could go into detail.

even though he did not sign the check did he write out all of the other parts of the check? or did your daughter fill in everything?

Best bet is to get the guy to admit on tape that he gave permission for the check and the 950 dollars versus not remembering

if none of the above can you make arraignments to re-pay then next time he is high or drunk have him sign off releasing your daughter from the check

I think you should compair this check with other checks he has given her, if he wrote the amount on the check he is responsable to pay the 950$. If she wrote the check she should make arangements to pay back the money, they will go easy on her because she's 18 and paying back the money.

It's grand larceny because of the amount, and there's also a separate check fraud case. I think the legal ramifications are commonly known as jail.
