He took loan from our company 800,000. and is hiding in his country leaving his wife and kids here. Not ready to pay the money back. His wife is very good friend of mine she can not go to his husband coz my boss took her passport and is saying that he will not let her go until her husband pays back the loan - she has nothing to eat and comes to my office with her kids crying to my boss to give the passport. Police says the same thing as my boss. HOW CAN I HELP HER?????

What country are you in? How did your boss get her passport? if you're in the US, she can sue your boss. The tort is called "conversion" and it means somebody took something of yours but doesn't intend to steal it. If she gets a judgment, which I'm betting she could do in small claims, she can then get the police to enforce the judgment.

Another route, however, is to see if an attorney will take the case and sue for punitive damages.

If you look inside and passport you will soon learn that the actual passport itself is the SOLE PROPERTY of the issuing government body. Under very few and strict provisions may passports be held - and then ONLY by Law Enforcement Agencies, Her passport has now been STOLEN by this "boss" yours. She must contact the closest consulate of the country where the passport was issued. If it was issued in, say, Ghana, then it is the property of the government of Ghana. The consulate will contact the right person on the other side (perhaps the American Embassador to Ghana). It will work its way like this down the food chain until it gets to the point whe the police will need to visit YOUR BOSS and then HE WILL BE THE ONE IN TROUBLE. This issue is an entirely separate one from the action committed by her husband (who went bye- bye some time ago). The wife has done nothing, and there is no evidence that she had committed any crimes. She has no recourse: she and her kids are STARVING. If she were truly in cahoots with the husband, then why are she and the kids left to starve in the US. The husband has abandoned his entire family. My heart breaks for this poor woman and her children who were treated abysmally. TELL HER TO GET TALKING TO HER CONSULAR OFFICE/EMBASSY THIS VERY MORNING. Perhaps you could also put her in touch with the "???????" immigrant community. Someone there may be able to help her further. Best of luck to them, and I'm sorry it turned out this way. Men are the purpetrators of most crimes, and the women and children pay the price. Sounds oddly like WAR. SHE NEEDS TO MAKE NOISE. Cops can be pretty thick about novel situations. Be her friend.
