They can subpoena you without ever even calling you first. And if you have no information your best bet is to call the public defender and tell them that. You have a much better chance of not being subpoenaed if you tell the PD you won't/can't give any info.

My best suggestion for you is to call the public defender and ask him what he/she wants. Before you say anything, listen to what he/she has to say. Then tell him/her what you know or do not know about the subject he/she has called you about.

You have to know this public defender is calling you because he/she believes you have information that can help his/her case. If you do not respond to this public defender, you will undoubtedly be served a subpoena to appear in court. That public defender is going to get the information from you one way or another: voluntarily outside of court, or in court after forcing you to appear.

Keep in mind, however, that you may still end up in court, even after you responded to this public defender. He/she may think that what you have to say is so important to his/her case (even negative information) that he/she will want your testimony, under oath, in court.

Be truthful, and good luck.

I get the feeling you have info and just do not want to tell/get involved.
