recently ive ended that job but hes not paying me my last 2 paychecks.. i havent been claiming that as an income cuzz hes never game me the papers from day 1.

ive been workin 4 him for 3+ years and i got a weekly salary, i actually liked the idea of being paid cash, but now hes bein an A$$.

If you are an employee, you should be receiving W-2's not a 1099. 1099 are given to people who are contracted work, or self-employed individuals. It is your responsibilty to declare your income whether you were given documentation or not. Especially if you were paid by checks or direct deposit. You could get audited and could pay hefty fines and interest.

Also, if you should be paid as an employee, you could get the employer in trouble. Sometimes employers use the 1099 as a way of getting out of paying their share of employment taxes.

Also, Earl seems to have the right idea, but a little off. 1099's are to be postmarked no later than January 31. 1099-Misc are only required if the amount is $600 or greater.

You can report them to the IRS.

Threaten them.

Write them a letter (send it certifed) and tell them you are intending to file a claim with the IRS and have them auditied.

If they regulate WHEN you clock in WHEN you go to lunch WHEN you go home,
then they can't use 1099, they must use W4 and pay half of ur SS and all of ur Disablity.

To be 1099 you MUST have the freedome to come and go as you please.

If they ever regulated you, then they are in TROUBLE.

Threaten them.

Quote the law, tell them you are filing a complaint with the IRS and wait 30 days, then file a complaint.

Tell them u want your last paycheck or you will complain.

They don't have to give you a 1099 until February 15th of next year and only if they paid you more than $500.

Well, if he didn't give you any papers, why the hell did you decide to work for him?
No paperwork/claim as income, no paycheck, buddy.

File a complaint to your state department of labor. You worked for him, he is legally obligated to pay you. You will need to be able to prove that you worked those hours.
