The brother in question is my ex brother-in-law. The woman he is living with is still legally married to his abusive brother. Since in this province one is considered legally married, (comon law), after living together for one year, how would this situation be veiwed in the eyes of the law?

In our state, living together alone does not make you common law married. You also have to meet one other criteria out of a long list, some of which are: Present yourselves as married; Use his last name; file taxes jointly; etc.... In our state you often hear people say you have to be together 7 years to be common law married, but that is a myth. There is no set amount of time in Alabama, as long as you meet the criteria.
However, if you are already legally married, you can't marry someone else, so therefore even if you met those criteria, you still wouldn't be common law married. The only reason the law even recognizes common law marriages is so you can file for a divorce if you need to, like if there are custody issues or joint property that needs to be divided.

some people. first off the brother had no business opening his zipper to his brothers wife. Yes he was abusive. But opening your front door and zipper is not the way to go. The brother should have got help for his brothers abusive behavior. Gee I would like to be at grandmas house on holidays. The brothers wife is living with his brother.... must really stir up a conversation at family reunions.

They'd be considered roommates and nothing more. It will not be considered common law marriage because she is still legally married to another.

If she never filed for divorce, she is still married to the abuser, even if she separated for 5 years. Until she actually files divorce papers, she will still be his wife. That's how it is in Illinois....

BIGAMY ILLEGAL. And even if it is not be on the safer side by getting a divorce and marrying the person you want to live with for your whole life

Yes it is unfortinately. I know a friend that was married. Then he divorced her and married her sister.

if it's in America I think she can live with whomever she chooses. I'd hate to be told where I can or can't live.
