If you are a defendant is a lawsuit, you must be served with notice.

Or if you have an attorney (or for corporations, an agent for service of process), they can be served with notice on your behalf.

While the individual requirements vary by state, it is almost always in written form. It can be affixed to your residence door, handed to you (or to another adult resident in your home), or mailed to you.

Once you have received notice and service of process, you have a specific time to respond. If you are expecting to be sued, now is a good time to start looking for a lawyer, who can also explain the specific details regarding service of process in your state.

If someone sues you, you will receive a summons and complaint. Sometimes and depending on your state, the small claim courts send a notice to the defendant, but as far as the proper service on the defendant goes, you should be served in person and the notice from the court does not suffice.

usually, their lawyer will mail you a notice, inviting you or your lawyer to contact them to resolve the matter beforehand... and warning of the "legal ramifications" they will take if you do not respond.
