The Libertarian party is based on exactly this same question.
A person's freedoms stop at the end of their nose. Drinking is legal, and so is getting drunk. But, a person's behavior while drunk can be illegal. If that drunk starts a fight, or drives then they are endangering other people and at that point their freedom ends.
Prostitution is illegal, but it is called the victimless crime. Our Puritan society objects to easy sex. In this case though this sex doesn't hurt anyone. The man gets what he wants and the woman gets paid. So the Libertarians would decriminalize Prostitution, and I think that is a good point. Some forms of Prostitution should be illegal; mainly that where a child is involved or a person is forced into the act. Most Libertarians would agree with me. A child is too young to make decisions about sex, and forcing someone into a sex act is denying their freedom.
The problem with prostitution is that it leads to other crimes like drugs. It can also lead to the easy transmission of sexual diseases. This problem isn't as prevalent as it is in Europe. In Germany prostitution is legal, the women run a houses as a business. They are inspected regularly for diseases, and if they get involved in illegal activates they get busted. They are also taxed. This is the way to do it, and Nevada has proved that it can be done in America. Surely you remember the house of prostitution that fell into the hands of the IRS. For a time the US government was running the house.
The government puts limits on our freedoms so that we do not abuse the freedom of other people. Celebrities have the right to move freely in public like anyone else, and photographers have the right to take their pictures. However, when a photographer starts to abuse that right then the Stalking Laws can come into play. The problem is that sometimes the government gets carried away. They try to limit freedoms that some people consider to be dangerous. Alcohol is, arguably, just as damaging as marijuana, both have been made illegal. The prohibition against Alcohol didn’t work. People still drank and didn’t care about the law against drinking, that’s why the law was repealed. It is also why completely outlawing smoking won’t work, although many people are trying to. I don’t’ smoke and consider it a dangerous and filthy habit. However, as long as you know the risks, and don’t endanger me with your habit, then you should have the freedom to smoke. Libertarians think that the maximum of freedoms should be allowed, even harmful ones. The adult should know where his limits are and if he breaks those limits then it is his own fault.
The antismoking laws originally were designed to do prevent smoking from harming nonsmokers. Some people have gotten carried away though. Fort Dix has outlawed smoking among the recruits (the Army runs its Basic Training course at Fort Dix, so every Army Soldier has to go to this post). They have also tried to outlaw it on the entire post, including soldiers not involved with recruits and civilians. A company has engaged a company wide no smoking band. They gave employees a year to quit, and offered free assistance to quit. A few employees didn’t quit smoking and got fired for it. Both cases have valid reasons; the company claimed that it was cheaper to afford insurance for nonsmokers, so the decision was strictly a monetary one. I don’t think that is the real reason though.
Our society is based on freedoms, and we need to have as many freedoms as possible. The Bill of Rights assures these freedoms and they were written at the same time as the Constitution was written. I don’t know why they weren’t included in the Constitution itself, except maybe to show that the Constitution can be amended and still be valid. Government’s role is to protect those freedoms and to insure that our personal freedoms don’t damage other people. That’s why shouting fire in a crowded theater is illegal, unless the theater is really on fire. So we have to have some limits on our freedoms, but I often think (as do you, I bet) that the government puts too many limits on those freedoms.
