The guy conducting the interview said my resume was not acceptable and that perhaps I would be better suited for a job in the fried foods or grape soda industry.

My questions are.. What the heck did he mean by that?

And does it sound like I might have any kind of discriination lawsuit?

It does seem fairly dicey.
Every time that I send a resume out, I don't get an interview so I would assume that the if the resume was good enough to get an interview then it seems very odd that the resume would be used as an excuse for not getting the job.
To me it would seem that the resume was good enough to get a job interview UNTIL he saw you. At the very least this person has some explaining to do. It is at the minimum an extreme lack of class to invite someone for an interview only to tell them that they are not worthy of an interview. It seems to me that to wonder if the colour of your skin was the deciding factor is not unreasonable, nor is it unreasonable to ask for an accounting.
Definitely talk to a lawyer.

You can try to sue....I'd contact the ACLU to see what they have to say. They should have on record any other complaints about that company or person.
Discrimination in an interview is going to be hard to prove though. Employers have to be very careful what they ask potential new employees. Doesn't mean it didn't happen though.
Although if you were applying at a Fortune 500 for a office job and only had experience flipping burgers yeah I would respond the same way regardless of race....I would just have the common sense not to say something.

Honey if you have not expereinced weak people abusing power welcome to the reality series "real Life".
he probably meant that "your people" do better in fast food since "your people" eat fried chicken and drink grape soda. You will have many little "hits" that ignorant people will throw @ you to see how you will react. with out hard proof I don;t know a lawyaer would be beter able to tell you.
meanwhile A letter to the supervisor of the interviewer cc to interviewer and thank him for time. but you realized that a company that tolerates (interviewers comments) as a way to find the best candidate is no longer a company you would want to help earn money for. describe the time of interview and a copy of resume used (make it look good on good paper etc) let them know you will call the ????BBB? local chamber of commerce? as well as share with friends that this company hires biased people. who knows maybe supervisor does not know this? If interviewer is head of things write the letter and cc it to a local senator or to whoever else you wan to know about it. hopefully it will be soon after the interview becaseu this letter is now your first piece of follow up.
I think a lot of people take advantage of what others don't know to abuse their "power" good luck

It sounds like he didn't like your resume' and that he though you may be way underqualified for the position that you were applying for.

Was it polite NO NOT AT ALL in fact, it was rude, down right ignorant, and shows very low caliber on his part.

If you had anything in writing that stated that YES you would have a case !!!

But if it is your word against his word you may not be able to prove anything.

At best you may get the job but he would make life hell on you as he would be waiting for you to clock in one second late.

I feel very sorry for you and all black people that have to continuously suffer from others like this person.

It is wrong, and yet they get away with it.

I wish you all the luck and I would seek a, "no fee for consult" lawyer just to see if you can do anything. It never hurts to find out all of your options.

One other thing, find out if the person he did hire is white.
Then go to your lawyer. Hiring a white person after the fried food comment, that is something.

Good luck my friend and I am sorry you having to deal with jerks like that.

He was discrimating upon you for being black. He was trying to be funny. It doesnt matter if you were qualified or not he still had no right to say it. And by the way people hes not playing the race card. The man made a racial statment. He ment that the only thing a black man could do is cook fries and make grape soda... the "*****" jobs.

what i would do is take your resume to a place that does resumes professionally. get an opinion on the resume. what kinds of skills do you have? were they worthy of the job? i am serious here. if they say that you have legitimate skills then yes i would say you have grounds for a discrimination case. even without it you probably have grounds because the guy is an idiot but without someone backing up the fact that you have legitimate skills that made you a suitable candidate for the job the suit could be thrownout of court for being hard to prove.

the guy is an idiot either way and most likely he was making racist comments but i would hate to see you waste your time on something that wouldn't be worth the effort. if someone validates your resume get some help with your suit.

Although this story sounds interesting, I as a black woman don't believe you. If they didn't want to hire you they wouldn't have even called you in for an interview. But in case this story IS true, I think you definitely have a discrimination lawsuit and you need to pursue it.

Before you get to hasty is your background in fast food, restaurant, worked for Pepsi co. or something. It may have been justifiable advice.
Otherwise Lawyers do give a free consultation and it won't cost to talk to someone about it. But I think that is one of the biggest problems today everybody sues everybody and end the end we all pay for it. Can't the kiddies all play nice in the sandbox? Have a good one:-)

Yes, you can sue.. but I would advice you to do this next time..

Bring a recorder (hide it, so no one can see) in the interview and record what the interviewer said. That way, you have evidence.

They should not haved called you for interview since you are not qualified based on your resume. if you sue now, they can say you did bad on the interview. You don't have a case and You won't win this time!!

Probably. I'd talk to the Human Resource Consultant (unless it was the Jerk!) and go from there. They are mandated to help in these situations. If it was the Jerk, you could probably get a first-visit-free with a civil rights lawyer to see if you have a case. If you weren't qualified for the position to begin with, you shouldn't have had the interview to begin with. I don't care what color you are, those comments were rude.
