I have been trying to contact her since July 19th, left messages, went to her home/office and left letters, mulitlple messages on her phone. We've done nothing to make her mad, but am simply trying to get updated on our case. We sent a letter off to my ex, we are going for termination of parental rights. If he did not contact our lawyer within 30 days, then he gives up his rights. The 30 days ended July 30. We know nothing, don't know if she heard from him,or didn't. She won't return our calls. We hate to change lawyers in the middle of the game, she knows our case so well. I've talked with someone from her home, just to make sure she was ok, and there was no family emergency. She's fine and so is the family. I don't know what else to do. We just want to know if my child is going to be safe from her paternal dad, and he will be out of our lives. Sigh. Help?

Apparently, for those that like to make assumptions, I must add to this. First, don't make idiotic assumptions based on so little information. My account is well up to date, and as of 3 days ago, have now paid 20,345.00 to protect my child. How dare you. I don't think asking for a simple phone call that would take 2 minutes to give a yes or no answer is asking too much. And if he was asking for more time, don't you think that is something "I" should know. I don't stalk her, but maybe I should. If that's what it takes to get her to handle herself in a professional manner and simply return a phone call. I think protecting my child is just as important as any "serious" case she has. This is getting towards the end of a long,drawn out battle, and protecting my child from someone on crystal meth, cooking it around her, and even getting busted for it tends to make me a little anxious to know the end results. For the others, thank you for your advice.

my best advice that I can give is to contie to be persstant. keep calling, and going there. Tell her its very important that you talk to her. Threaten to go and see another lawyer(she will most likely call back than because she doesn't want to lose a client)...explain to her in a very detailed message that you must know, explain whats happening and tell her it would mean alot to you if she wold just take the time of day to call yo back. Tell her you understand shes a very busy lady, but you are a client as well therefore she should give you the time of day also, continue by saying if she doesnt call you back you will have your file discontinued and you will go to another lawyer, by you saying that she will be afraid of a bad rep and be afraid of loosin you as a client. this is a long response to something from a long time ago unless you are going through a case where you are desperate and your lawyer and the system is making you pay for nothing you should stalk. I reached mmi with a failed fusion and the ic wants to settle my lawyer wont even make a offer as I beg him to twice a week. He is gonna be fired Monday if he doesn't put the offer of 240 k I demand I had failed fusion l4 l5 and herniation t11 constant pain but good enough 25 percent disabled. A lawyer is your employee no matter what they have a obligation to treat it so. Some lawyers take to many cases and take it out on you don't think so you hound them until they do what you want or get a new lawyer. Im done months without paychecks he always amswer and is a nice guy but is old and doesn't like to settle oh well not his choice the quicker he realizes that the quicker im out of his hair my medical for this failed fusion was in excess of a million dollars case has value of around 300k if I settle and drag it out or a million dollars as im 29 and am almost guaranteed to get hurt again. But no one knows the financial stress I was making 90 k a year now I get 420 a week and lawyer takes 5 th check I have a kid and a family I had to sell my car to feed my family to not getting checks for a month at a dime collecting 35 dollar over draft fees constantly. Credit ruined drastically this is your life and do whats best for you. A lawyer isn't wanking you or raising your kid you go there and wait for them to show up they have to be at office one day and I would be waiting to give him the pink slip and a report to the bar. The moral of the story is do you no matter what anyone says on here no one knows specifics of each case and you get morons answering that have no clue what the system is like. Ive been falsified police report for a DUI when I wasn't even in parking lot with my car an had no keys on me to vehicle the system is a joke and so is everyone else here with there personal opinions on situations they aren't involved in lawyers have 2 days to get back to me if not they don't have my best intrest and that's all I care about I felt nervous and whiny all the time giving my lawyer chances and saying im not mad at him its not his fault but I said this to him 20 times in 2 years now I think about it hmmmm no more sorrys I want to get paid now

Quite honestly, it sounds like you have been the kind of nightmare client lawyers try to filter out of their client loads, and I don't blame her for avoiding you. Your conduct sounds very unstable.

Your legal matters are important, and critical to your family situation, I understand. But a lawyer in this kind of practice is typically juggling about 50 cases at a time, all with people in "life or death" circumstances screaming for attention 24x7... and contrary to popular myth, is probably just barely making a living off that kind of workload, not getting rich. If you were doing clingy, panicked, desperate things like calling 3 or 4 times a day and becoming irate if you didn't get a call back the same day when she was in and out of court and/or juggling half a dozen more serious emergencies for 16 hours a day, all you have accomplished is to label yourself a "problem client" for whom the lawyer must set boundaries. You actually went to her home and contacted her family over a business matter? I'm sorry, but I would be going to the police and filing a stalking complaint if you did that to me! Sheesh.. that's scary. All this is doubly true if you have also been a payment collection problem... it never seems to fail that the most unreasonably demanding clients are same ones who don't want to pay for all that time they are insisting the lawyer put in.

Get a new lawyer, you have shot your credibility with this one and poisoned the relationship. And next time, regulate your conduct and adjust your expectations, and you will be much happier.

I am a lawyer. We quite understand the eagerness,nay overeagerness of our clients to get quick results.But matters of civil nature, for instance your case, do take some time for settlement. Even if there is a time limit prescribed for a response from the father there are provisions where he could seek exension of some pretext or the other. Despite such procrastination may be deliberate since it is within the four corners of the law you cannot just wash you hands off.Sometimes it is quite frustrating for a lawyer but he can t ake it with eqinaumity as a professional matter. He must have assured you that since you have entrusted the matter to him you need not overwork yourself in the matter. He may not like to add to your frustration by posting you with each and every ruse of the father to delay the matter. Since you believe you lawyer and have not suggested any foul play the best course for you is not to worry and not to worry your counsel. However, in case you feel that something is amiss you can take up the matter with the Bar or even change the lawyer. However, even a change is no assurance that the matter may not be delayed.

Check the criminal courts, my friend had this happen he kept going to the office for weeks and finally the Secretary told him all the attorney`s cases were being transferred to another lawyer and a few months later in the paper he was sentenced to do quite a bit of time for embezzlement with Labor and Industry cases.

If your lawyer is part of a larger group, you should contact them to insure that your case is getting the attention it deserves, especially considering the money they are (no doubt) charging you.

If there is no other lawyer to contact, you should contact your state bar association, and report the situation to them. If your lawyer is acting inappropriately, then they will follow up on it.
