Gee - 3rd marriage for your hubby & he wanted a pre-nuptual. Red Flag.
A prenuptual agreement is a legal agreement between 2 persons when they marry. usually it is drawn up because of either an anticipated divorce, or one person is not willing to share with the other, or may feel that they could be taken advantage of.
More than likely, you would need to get your hubby to sign-off and either rescind the prenuptual OR you could both come to a Mutual Agreement & then amend the prenuptual agreement.
I would strongly recommend carefully reading the language contained within the prenuptual agreement, as there may be clues in how to void it. IF you are not familiar with legal terms, I would consult with an attorney who specializes in CONTRACTS & has a working knowledge of divorce proceedings.
IF you happen to be short on cash - I would sign up for a Pre-Paid Legal plan & make sure that you will get access to attorneys who specialize in contractual law. That way, you only pay for a few cents-on-the-dollar, and can get legal advice.
IF you prefer, you could ALSO try chatting with a lawyer online (free).

They will require you to sign up - but it is free.

Good luck. ☺

Matrimonial laws vary from state to state. Consult a local family law attorney. California and other states have adopted the Uniform Marital Agreement Act. Check out the link below if you want to see the version California adopted. It contains most of the grounds to set aside a prenuptial agreement like fraud and coercion.

Unless he agrees to enter an order with the court reneging the original agreement then your stuck with it. Chances are after 19 years he's going to find it rather fishy that you all of a sudden want to dissolve the prenup.

You can get him to sign a marital agreement that voids the pre-nuptial.
Otherwise, you'll need to find a way to void the contract like any other contract. Unconscionable, duress, and etc. etc.

You can't if you signed it. Try not agreeing to one next time. Good luck.
