a guy that works in the same building as me. Had a confrontation with another guy in the building. After the incident, one of the guys was bad mouthing the other at work. So in retaliation the other guy said he was a rapist. Is that a crime?????? They are both pecker heads anyway. I found it humerous

Good for him I'd say, There is no crime in speaking your mind. Michael Jackson has raped several children and people love him, Why cant this guy?

If the statement is not true, and said in front of witnesses, then it is slander, not liebel. Liebel has to be made in writing. Either way, it is not a criminal offence, but it is something somone can collect damage for in court.
Please note what I said about the statement being done in front of a witness. That witness has to be willing to testify and be believed in order for someone to win a lawsuit. The plaitiff may also have to prove damage was done by the statement.

I would think that the boss would take them aside and tell them that even if they don't like each other, they need to leave that stuff at home. It is inappropriate for the workplace. And I would think that calling someone a rapist would be considered libel.... unless it is true of course.

that comment could literally ruin that mans life. it could turn into a crime if the man is ever arrested on nothing but a lie. if you know these men, please go to the one who made the comment, explain what could happen and try to convince him to rectify the situation. good luck.
