Find an attorney and get the petition ready. The day after it is filed, tell your spouse, "Our relationship cannot continue. I want out. I have hired an attorney and you will receive notice soon." "I am sorry this hurts you, but I need to move on."

Just like you did. Speak from your heart. This is such a tough thing. I would hope that you try everything you possibly can before you split. You might just find that you may get closer in the process.
So many split up today over minor things and instead of learning about each other in a deeper way, meaningful way, they just throw in the towel.
If you KNOW you are done though, just say it and do it quickly. It lessens the pain. It's going to painful no matter which way you cut it.
I am sorry for you. I know exactly how hard this is. I'm 36 and have been through it already.
Good luck.

The only reason for getting a divorce would if he was unfaithful and broke his marriage vows. Regarding separation, there could be other justifiable reasons, for example if he were violent, very irresponsible or something such as that.
You have given no other details, and getting a divorce or separating without a good reason usually represents a complete cop-out, a horrible contempt and is on the level of a soldier deserting the army, in my opinion.

1. Get your own bank account first. And make arrangements for a place to stay, at least temporarily, even in the event you expect to get the marital home for yourself.
2. If you have to ask the question here, then perhaps you should have your lawyer tell your spouse.

It was very hard for me to tell my ex that I just wasnt happy anymore. I know the longer I waited the harder it was.
One day after work, I just sat down and told him I had been thinking of moving out.
The longer you wait and ponder on it, the harder it will be and make you more miserable. So, for your own sanity, just tell him and get it over with. Then you can move on with your life.

It will probably be the hardest thing you will ever do, but the only way to do it is straight up and honestly. It causes less hurt in the long run, than if you chicken out and try to hide it.
