I am confuse and angered. A person who have sustained a permanent injury, and cannot return to his/her regular and customary work is awarded an amount based only on the disablity rating.
How about the fact that the disability have cause continuous emotional and psychologic distress, pain, and inability to attain the same capacity of work that he or she had prior to the injury?

The psychological/emotional damage is usually calculated into the 13% disability rating. This should affect any settlement monies you are awarded. If this was an accident of some type where another party was at fault, you can also ask for punitive damages.

A 'fair' monetary settlement would be 13% of your potential earnings before the disability. The actual amount would depend on your earnings ability.
