for an example, after 1 to 5 years of marriage and two children later, their spouse says, "Honey, I'm gay. I've always had a passion for men (women). And Oh, by the way, I'm leaving you for John Doe or Jane Doe? This is assuming that the straight party had no idea prior to marriage that their soon to be husband or wife was gay before they met.

This kind of thing happens. Sounds like grounds for divorce.

I think the normal REASON this happens is that the gay party doesn't understand their own sexuality at the time they get married.

I also suspect that, typically, the gay person doesn't run off with the new homosexual partner. Instead, the gay spouse presents the belatedly discovered sexual truth about the orientation and the hetero SPOUSE decides not to put up with the circus -- 'though often that hetero spouse compromises on the nature of their wonderful relationship and continues the marriage.

No. You cannot sue a spouse or partner for lying. If you could - half the people in America could be sued for breaking their marriage vows when they cheat etc. I am sure your partner didn't mean to hurt you. Many gay men and women try to stay in the closet and fit in with society's expectations by marrying. Most get to a point where they can no longer live with the pretense of being "straight " and for their own mental well-being have to "come out of the closet". I am sure your spouse loves you - just not in the way you expect. Since you have children together - please try to understand their dilemma. After all - you will have contact with this person for years to come and your children need your guidance to deal with this situation. Good luck!

You could file divorce proceedings on the grounds of fraud. But why put your children through anymore than they already going to dealing with. They will probably have a hard enough time with the issues that you will have. I know that you are upset and that is totally understandable. Who wouldn't be? But you need to take a step back and be the bigger person right now for your children. Good luck!!!

Sue for mental anguish after finding out your spouse was gay? I would be concerned about a countersuit from them... spouse turned me gay! give ME money for mental anguish!
Sorry Im making light of this.
It happens .. it happens alot.
Just divorce, move on and keep it civil for the children.

This is a silly question. Are you talking suing for divorce or for a perceived injustice and money? For about $295 you can file a lawsuit in just about every state for just about any reason (i.e. the sky is blue). It doesn't mean you are going to win or that the judge won't rule it frivolous but you can sue.

You can sue for the standard divorce. If you're looking for some type of extra compensation just because this person cheated or went gay...you're out of luck.

So once you're married, that's the two uninteresting, or you're bored with scuffling with. because you're bored perhaps you ought to attempt to create some exhilaration. Like purely the two one among you going out to dinner and to a inn for the night. on the inn, you've got some thing particular waiting up like a candle easy bathtub, with roses in the water and likewise between the sheets of the mattress. you ought to discover a sitter and make him a romantic dinner and then share one yet another for desolate tract. i think of in case you place some power into this marriage you ought to convey it lower back to existence. on condition which you're keen too. yet once you're unhappy, perhaps you ought to discover some happiness interior of your self. study some self help books. I constantly have my consumers study Louise Haye: you are able to heal your existence. this could be a large e book. yet constantly remember happiness comes from interior of, no longer from our mate. As for divorce, in case you experience that's what you go with for, then do it. yet please do no longer stay married for the toddlers. They understand and experience what is going on. mum and dad do no longer comprehend how lots their toddlers are conscious of how they experience. so which you're able to being doing no longer in basic terms your self an injustice yet additionally to the toddlers. stable success and God Bless
