Many criminalls will have thier attorney say to the prosecutor that the defandant has a disease ,addction" alcholism" to get out of going to prison or jail . They will ask and often get to go to a 28 day rehab . Then probation with AA meetings .
Often they are repeat offnders with serious records. yet we as a society let them off with rehab and meetings which the are often alrealy found their victim through !
Yet a person who is truely mentally ill often end up in prison where the quickly become victims of some of societies most evil.
We claim not to like the insanity defense in fact outside of the disease of substance abuse and its growing spin offs insanitiy defence of any type are succesfull 1% of the time

Why then do we let sane criminals off with rehab and AA to reoffend ? AA/NA claims all addicts are insane yet they are well aware that they are breaking law , fail to to fit medical or legal insantiy burden is this justice or imoral ?

Because prison does absolutely nothing to solve the problem. And treatment does.

People who are addicted to drugs or alcohol suffer a medical problem. One that can be treated, so that the person doesn't drink or take drugs again. And if the choice is spend $5000 locking them away without treatment, or spending $2000 with a 50-50 chance of them getting clean so they don't abuse again, which makes more sense?

Where the problem can be treated effectively, punishment does absolutely nothing. And punishment is more expensive. But treatment is only an effective answer for those who are personally using or abusing. It's not a solution for dealers or those who voluntarily choose to commit crimes that actually harm someone else.

Well, you can't blame a person for trying any excuse to get out of going to jail/prison. The courts often go for it because it is cheaper than housing and feeding a person while giving the ILLUSION that something is being done.

I think the insanity defence is a major excuse too.

Doing this only makes the majority of law abiding people who have troubles with addiction or mental health issues look bad when they attempt to secure their rights, e.g. responsible jobs, loans, custody of children, etc. Any scofflaw with a mental illness or even thinks they might have one can say to anybody that they hallucinated and their "voices" told them to do something and there's no way to prove that or not to ...

I know of no such claim by AA or NA that says all addicts are insane and they are well aware they are breaking the law. I don't like wasting my answers on questions that clearly don't have the facts correct.
