it is very rare to get a ticket for being high , but it would be public intoixication . Where i am if you have more than 2 ounces it is considered distributing , also if you have more than 2 bags of any amount that is distributing . so the best way to go about it is not to carry more than 55 grams ( which is 1 gram shy of 2 ounces) in 1 bag and it will only be considered possesion which is no big deal compared to distributing , regardless you are going to jail for atleast 1 night no matter what . It all depends on judge but possesion could only be a ticket and maybe community service , distributing is probation and possibly prison

No legal penalties for smoking it.

There are penalties that vary widely by State. The penalties are in part- Possession, Possession with intent to distribute, Cultivating, etc.

Smoking it and or being high is not against the law. As long as it's not in public....

Just my opinion.

Don't go out and get busted.

It varies by weight and the state you are in. Just smoking a joint would likely be a small fine in most states. There is a DVD called "high times cannabis cup 2004" that lists each states drug laws.

Depending on the amount that you have on your person the charge is different in Alabama Possession of Marijuana 2ND degree is a misdemeanor, and depending on criminal history then the judge would decide to what extent you would be punished. Possession of Marijuana 1st is a felony, So if you are formally charged with that you will be a registered felon.

Depends which state you are in, some states treat pot as misdemeanours and others throw the book at you. Don't have more than a joint on you at a time and eat it if you have to, best advise I can give you.

Depends on city and state. Don't do it ever, no matter where you are. Even somewhere like Amsterdam where it may be perfectly legal, still don't do it.
