You can file an amended return up to 3 years after the deadline for that tax year.

You must file a tax return if you have taxable income, regardless of where you lived.

Failing to file a return is likely to be viewed as either fraud or tax evasion by the IRS, even if the income was otherwise excludable.

You should seek the advice of a tax professional and file any missing returns immediately.

It is probably too late to get any refunds due from the 2002 tax year due to the 3 year statute of limitations. However, any tax due for that year along with penalties and interest are still due and payable as you failed to file a return for that year.

However, from 2003 onwards you are still eligible for any refunds due.

What has me confused is that you stated that you "filled my taxes but didnt claim a return do to being overseas". What exactly do you mean by that statement?? How can you file your taxes but not claim a "return" (refund??)?

Up to 3 years to claim a refund for Federal purposes. Your state tax may have a different rule.

You're out of luck for 2002, but you can file amended returns for the other years. You need to act quickly, though. If you have copies of your returns, you would probably be best off going to a professional tax preparer. Or I would suggest looking on eBay for past years of Turbo Tax you can buy to do it yourself.

Yes you can. Just call the state and federal IRS offices and they can do a research of refunds on your social security number and then issue you a refund check. Assuming that you don't owe them anything that would have to be paid back first.

The truth is if you filed your return and a refund was due then it would have been sent. How could you file and not claim a refund?
It may have gone into "unclaimed property" if it was undeliverable as addressed.

The statute of limitation applies.
