Of course they do. They don't know if you're an athiest, they don't ask you. Just the 'whole thruth, nothing but the truth, so help you God...' line would go right over their heads, as would the symbolism of lying with their hand on the book of God. I guess athiests should consider themselves somewhat lucky, to feel no guilt as they lie before God, whereas a true Christian would probably not be able to bring themselves to do this - and their the real lucky ones!
Hope this helps

Back when I worked in court on a daily basis, you had to raise your right hand and swear on the Bible in the name of God that you were telling the truth. If you say, "No," as if you don't believe in God, then you will "affirm" that you are telling the truth.
Whether they use Bibles today, I don't know, but it would be a crying shame if they didn't. What a society we've become.

Yes, even though a non believer is swearing on the bible it is not whether he or she believes-but under the laws and institutions of the govt perjury is still a crime and the "act" of swearing is just an agreement of understanding the consequences of any said actions!

No, anyone can refuse to swear on the Bible. They still offer it as the first option unless you opt out.

In South Africa you are allowed to affirm that the evidence you are about to give is the truth. I would assume the same applies in the US.
