Thank you guys for all the help and my mom started to talk to the landlord today and told him that he's a small dog and he can't do any harm. And it's not like we don't take care of him so by next week hopefully he'll say we can get him back

Sounds like you could be making this up.
Here's why I'm suspicious...
When you moved into your rental, what was your understanding about the rules for having pets?
If your lease stipulates that pets (cats/small dogs) are allowed then just the fact that your landlord "didn't like him" is not cause for you to have to get rid of your dog.
This is why I'm suspicious of your question.
If you moved in with your dog knowing you were allowed to have him, then why was it so easy for you to "get rid of him" without bringing to your landlord's attention that you were within your rights to have your dog and then fighting for your rights even filing a claim with your Tenant/Landlord Dispute Division of your Housing Authority?
I don't know, I'm not really buying your story...especially the "yorkie poo" thing...yeah, sounds like you're really broken up.
EDIT
I see the new information you've added and I still ask the same question...your mom is renting from this "landlord"....right?
Now, just what is the agreement (lease or rental) that is written into the lease regarding pets?
This is a legal issue...either your mom is allowed to have pets and the landlord has NO right to tell her she can't, or the lease stipulates "no pets allowed" and the landlord then has every right to tell you and your mom that the pet must go and your mother, having signed the lease becoming the leasee, should have known better than to take in the dog.
Again, I say..just because the landlord "doesn't like your dog" is not enough reason for him to tell you to get rid of it.
And, just out of curiosity, by you "getting rid of him"...where is Smokey now? With a friend? Animal Shelter?
MORE EDIT
Ok, I'm sorry I didn't believe you, ok. Many of these questions are made up by kids with nothing else to do and it makes you a little suspicious after a while.
Now, is there a way you can print out your question and the answers that are on this page and then you and your mom go and talk to your landlord?
Maybe when he sees what you've written he will understand all the facts and your strong feelings toward Smokey and he will have a change of heart. I mean, what harm can a small dog like Smokey do as long as you promise to clean up after him and make sure he doesn't damage anything?
Because, ultimately it will be up to your landlord whether or not to allow you to have Smokey back.
Be sure you show this page to your mom.
Good luck!

I would wait a week and see if your feelings change .. like if you can get use to the dog beinging gone . If not you should talk to your landlord about having the dog. Or move to a different place.

we you allowed to have a dog?
i know how it feels to loose your pet.
sorry about that.
was there anything in your lease about having a dog? if it doesnt say that you cant have a dog, then the landlord shouldnt have demanded that you find it another home

Have your mom make sure she gets the land lords permission in writing! You don't want to be screwed over.
