A 1099 employee is generally referred to as an independent contractor.

I would contact the IRS or a CPA firm for help. The referred source may be of some help also.

It's hard to help you without having a good look at your siutation.

Good Luck!

Sounds like a somewhat tricky situation for me to analyze...since I don't know/understand the whole concept of "drawing against future commissions." My advice would be to go to an H&R Block office or an accountant and talk to someone who is quite experienced with these situations. I'm not sure what's up with these companies not giving out 1099 miscs to folks because that is certainly what they are supposed to do. Not sure how they expect you to report your income otherwise. As far as 1040x is concerned, I would have a professional tax advisor help you do that - as you are talking about an amendment. But whatever you do have which would show how much money you made and any expenses you incurred for that job would be helpful. Unfortunately I do not have the 03 mileage rate since I've only been doing taxes as of this year, so no materials on that. But you should contact your employers and tell them you need that 1099 misc. and go to a tax professional with anything you have to help you sort out whether or not you should actually do an amendment. It's hard to tell you without seeing anything in front of us.

You will actually take advice from Yahoo Answers and file your tax return based on that information? Oh all right, the mileage allowance in 03 was $4.85 per mile.
