It's not a matter of legal, but a matter of requirement. It's a real b**** of a question, too, and more details are needed. Here is a link to the regulation that governs it. Give it a read and if ti doesn't answer your question, call the Board of Equalization and ask. If you are the vendor and charged tax when you shouldn't have, refund it. If you are the purchaser and were charged tax when you should not have been, ask for a refund from the vendor.

I'm not familiar with California sales tax. Some state impose sales tax on services, some don't. Charging any tax is required by law. If they claim something is taxed that really is not, that is fraud.
