i let my son visit his father... his father is in parole... his father doesnt return my son... he is violating child vistitation... i put a police report they cant do any thing because he is the father.... i have custody of my son... i keep hitting a dead end... now d.a. says i need to get a lawyer or to apply for attempt to withdrawl or something like that... i feel helpless now... i cant file for kidnapping .his parole officer cant do anything i dont know where they live since they gave me a wrong address. and if they do find my son they say its up to my son if he wants to come home... my concern is school is starting in 2 wks and i havent heard from them what do i do now...can someone please give me advice or tell me what i can do.....

Depending on where you live, if you have primary residence and main custody of your child, via court order, he has no right to keep your child. You need to call the cops again and show them the court ordered custody... what state are you in. Call an attorney, who could probably give you free legal advice, or your local courthouse.

Each state may have slightly different custody laws so anything said here could be different in your state. However the first question seems to be, what are the terms of the custody order if one exists? If your husband is in violation of a court 's custody order he very well may be in violation of his probation. First you must get a clear picture of what that custody order says or does not say. Advise from an attorney or a local victims rights group would be helpful. You seem not to have the juice to get something done. Find somebody with the connections that are required to make people move.

You need a lawyer, honey. If you have legal sole custody of your son then it is not up to the child if he comes home or not. Get a lawyer and if you can't afford one then call Legal Aid.

Get a GOOD lawyer, and may I say that that is many a mom's worst nightmare and I am really sorry this has happened to you. You and your boy are in my prayers.
