To claim a dependent - even if it is a child one must use the social security number on the tax form. If more than one person uses the same dependent and s.s. number it sends up flags.
The person legally entitled to the dependent gets to keep them on the form, the other person gets theirs backed out.

Well you can bring up that question to the I.R.S. and they can look into it. At the very least they'll get a lovely audit experience. They (the IRS) will probably not ever inform you of whether or not the person was doing it since it is private information.

If they have already filed and it is your dependent you can get a report from the IRS. BUT if they have permission to use that dependent it is legal to do so.

The IRS can request proof by birth certificate or court ordered guardianship.

call the fraud unit at the irs and tell them what you suspect. it becomes their problem then
