Illegal immigrants can and do pay taxes on their income in this country. they can and do report their income using tax ID numbers or even fake social security numbers.

That's the big point of contention here...what rights DO non-citizens have in the United States? I'll bet by the time Congress gets done, this one will be answered crystal-clear....
my nickel says that the illegal immigrant question will be best answered by either a) naturalizing the individual in question or b) getting them the hell out of our country, where they can argue their rights to someone willing to listen back where they came from.
Child support is payments for taking care of the child by one biological parent to the other, the payment being made to the parent that has custody of the child in question. While in a perfect world, responsible parents would naturally support their offspring, in this one sometimes that has to be helped along by a court of law. In this instance, in my estimation, both illegal immigrant parents, along with their biological child, need to be sent back to the country of their origin, and the matter of support decided there. This is one of those 'door-sill' cases, where some people have their foot in the door of the legal system, and are trying to decide having wages garnished, but since those wages are being paid illegally, how do you garnishs someone who's going to be a) unemployed in short order, and b) no longer in the United States, hence no longer under the US court system?
We've let this illegal immigration thing go on for so long now, it boggles the mind as to how it's been allowed to continue.
The Right Answer, in my view, though it may seem cold and unfeeling, is nonetheless that all parties concerned return to the country they came from, 'anchor baby' included....america's getting played, this is one of many sob stories...

I don't see why not, although it wouldn't be supported by our tax dollars. Anyone, regardless of their citizenship can give power of attorney to a US attorney to sue in US courts. I can't imagine there would be much money in it for an attorney to sue an illegal for another illegal, so I can't imagine this happens much. However, I guess in this case there is something about this case that makes it worth it for the attorney.
You can do the exact same thing in Mexico. I do volunteer business consulting for import/export companies in the US. A client of mine in Mexican court was able to sue a vender of his in Mexico for not abiding by the contract. I've seen other American clients be sued by Mexican business partners in American courts. It's just a matter of paying court and attorney's fees, and giving power of attorney.
