The thing is, would you have faith that the person before you is the Son of God? That's what happened. It was a total mob mentality. There were some important people who wanted him dead. Some people wanted to be on their side. Then their friends didn't want to go against their friends. And others were too "nice" to say anything. Kinda what we do today with the salvation message. We (myself included) are so "nice" that we won't tell our family, friends, and co-workers that if they don't know that Jesus is the son of God and died for our sins and was resurrected, then they will go to hell. I know it's blunt and people consider it a hateful message, but think about it: nobody is being condemned here, an offer is being made. The choice is yours.
I guess I should actually answer your question now: I don't know.

Of course, since I'm not in favour of capital punishment, but I don't understand the purpose of the question...

Yes. The death penalty is too harsh a punishment for disturbing the peace.

In this day yes, we have the freedom to do that. But in his day if you spoke up you would possibly be crucified yourself.

Sadly, we do not learn from our mistakes. Therefore, I'm pretty sure we would condone it.
