A traffic accident only reports what happened pertaining to an accident. On an accident report, other violations or citations issued will not be reported, as those are criminal matters. If you are that worried, ask if a seperate report was filed concerning the assault.

If its not in the police report, then it didn't happen.There were probably two reports filed, a police report and an accident report(in NY mv104) If the PR does not mention anything about the alleged assault then u r fine. The accident report should have the accident details in it ,Did you give the Police any wittiness names? In NY people have up to one year to file a warrant card.She could theoretically file something down the road but every day that goes by she loses tremendous creditably.People think that everything is "assault",There needs to be Physical injury involved.If none, then it could be a harassment, at best.(a violation in NY,not a crime). I've been on the job for 14 yrs and responded to hundreds of car accidents,people get very angry when they happen.Chances are that the copper that responded saw the whole picture. I don't know how they do it but most girls can cry on demand.Most coppers can see thru it. Sounds like you r fine.If you are still worried contact an attorney, they should be able to calm u down.

cops are pretty good at reading people and maybe he saw through her lies. But all she has to do is hire a good lawyer who can manipulate the truth in court. I think she has up to year to file a lawsuit against you. If at all possible just to be safe I would go back to where it happened and do a little leg work and see if you can find any witnesses. Or just wait and see. The police report not having anything about assault and the fact that the report should show that she was at fault are good points for you. You could have been arrested for the assault if the officer really thought it happend. so I'd say you are 75% worry free.

Everything should be on one report. Was there any witnesses at the scene of the accident. If there was, then maybe she thinks that you got some names to support you. We can only guess at this time why she didn't pursue the argument that she claimed,"physical assault or abuse". As long as you didn't physically strike, shove, push or touch in any way, then I don't see what grounds she has to declare, "physical assault". Just in case, was there any witnesses and did you get any names and phone numbers? Now, that is for the state I live in.. I hope this helps.. Good Luck..

It depends on the state you live in and the criteria that the statute sets on defining assault. For the most part, assault is the mere act of placing someone in fear of their safety (i.e screaming, gestures, hostile remarks, etc.). If there is physical contact, then it is battery. I'm an LEO in SC and those are the guidelines set by our statutes, it may be different in your state. As for the accident report, it won't mention the alleged assault. There would be a separate incident report for that. Check with them and see about that. Generally, its up to the victim to take out a warrant for an assault.

Screaming is not considered assault no matter how rude it is. Were either of your injuries reported on the police report? If they weren't or there were none and it was her fault on the police report then I think your off the hook. If there were injuries like she got a black eye because she hit you first, I think a judge would laugh her out of the courtroom. If you did assult her and she got a black eye it might be considered road rage, but thats real iffy. You have her insurance company on the report, find out if she was even insured. Witness reports are the key, do you have access to those? If there were none then your rage is unprovable.

Call your insurance first if not done already. If the woman is at fault then her insurance will pay for your car damage. In the heat of the incident you shouldn't have yelled at the woman because she was probably in shock as is with being the accident. I wouldn't blame for pressing charges on you and calling it an assault. Was there any witness around to see the incident? Perhaps if you talk to the woman nicely and try to come to an agreement or apologise to her then she might drop the charges.

That wasn't a physical assault unless you put your hands on her. It was a verbal assault and I don't believe there are any laws against verbal assault. Something to do with freedom of speech well unless you threatened to hurt or kill her..hummmm then that may be a another issue. Why don't you talk to your local police? They should have the answers for you.

You can't find your mate?? Not much of a mate. It's your responsibility to make sure he was insured in your car. At the least you will face an "Aiding and Abetting" charge. Also they may consider your mate to be an invention of yours and throw the book at you for all the results including attempting to pervert the course of justice

did you happen to have any eye witness's near by that saw the crash? it would help your situaion plus....if i were you i wood explain to the police that she scared you and heck who woodn't be after a wreck like that! I was in wreck only it was head on colliison and the kid speeding doing 80 in a 25!!! lucky i survived it!! but defintly explain your side of the story and get a lawyer if you feel you need one! much luck to you!
