I am a Canadian Citizen, who is waiting on a US waiver. ( I had a small theft charge that was dropped, and do not have a criminal record,) but the US still requires me to apply for a waiver.
I am engaged to an American and we wish to marry and live in the States (he has children from a passed marraige) will my waiver affect my plans for applying for my K1 visa, and settling down in the US?

No it shouldnt allthough you need to file a I-129F it is a fiance/spouse visa. They are currently working on the ones from March so you need to hurry and file so you wont have to wait as long. To double check, check with a lawyer. Hope this helped. Everyone has to do the waiver thing. We will too.

Actually, the waiver needs to be approved before the State Department can give you a K1 visa. If the charges were dropped, then there is no conviction, so they should not be requiring a waiver anyway. Under the immigration laws, only convictions count --- not just arrests. I would clarify the issue with the U.S. consulate before you undertake the painstaking process of filing for a waiver and waiting several years for an answer....
