Ok say I got a traffic citation. I send for a court date. Two weeks before court date the officer is killed in line of duty. Will case be dismissed since he wont be in court to testify against me.
I always heard if officer does not show up it will be thrown out of court? Please help

In case you people not heard we have lost 3 police officers in two days. All three were motocycle officers.
one was ran down while trying to stop a speeding car in a local speed trap.

Ok, first out of respect for the officer if you are really guilty you should live up to it, work out a deal with the DA for no points if you take traffic school or something.

But since he is dead they will be allowed to read his report into record as proof if they want to. You can object, but depending on the rules of evidence in your specific state, since the incident report or incident card he did will be signed by the officer and he is not available to testify, they may allow that to be introduced into evidence. rules to allow other evidence in, if the witness can not be present for good cause is often allowed. Merely being absent is not,

Now on the other hand, the judge can go either or two ways, in his memory they may just dismiss all his tickets outstanding.
Or the judge to honor him may find a way to find you all guilty also.

I you challenge the citation it will be dismissed. The Officer is not present to testify. My prayers go to the fallen Officer's.

If you take the time to go to court they might knock off 20 bucks
