I know our court papers say that we have to have permission of the other parent or the court ( we have the same type of custody of my step son ) to even take him out of the county. Re-read your custody papers and if you cant find the answer file with mediation. Good Luck

Yes she can. and there is nothing you can do, but she has to still go by the contract that you guy's made (visitation times). However if you catch her before she leaves with him then you can go to the court house get a document and make her stay in the state until you have a court date and the judge decides. However if this is for a trip or something of that nature just let him go. You will have bigger problems to deal with at some point.

If it isnt already stated in your divorce papers, get an order from the court that she cant take him out of the state, if this is done and she does take him without your permission, she can be arrested and held in comtempt. You didnt say why he was going to fla. there are exceptions. If this was an educational trip with school or church, court will favor on her side. You would have to show reasons that you didnt want him to go. But you are the father, fathers have rights. talk to your lawyer.

She can take him on vacation out of state without telling you if she chooses. It's rude of her not to give you some kind of warning or choice in it. But I believe she is within her rights. If your son comes back, then it's fine. If he misses your visitation period, then will be the time to make something of it.
