my sons dad has not return my son,he was suppose to return my son a wk ago... i was told he was filing for custody of my son... he has never been in my son's life.. my son is 14 i have never recieved child support from my sons dad.. he is in parole... he just got out of prison a few months ago... i need to know what can i do and can my sons dad take him away from me... out of his 14 yrs hes only been with him 1mth1/2.. he put cps that i kicked my son out of my house which i didnt ... can someone please help me?

If your son is with him and they are having transportaion problems, the no you cannot get him arrested for kidnapping/child abduction, because you cannot prove that he was not trying to get your son back to you. Also, if he hasnt paid child support for that long, forget about it, its only 4 more years golddigger. also, you're gonna get smart *** people answering your questions on this site, it is open to the public. go talk to a lawyer if u want a serious conversation piece. o, wait. u need that money from ur baby's daddy for that though, right? also, shielding him from the truth, HA Bad idea. No matter what eventually your son will hate you and his dad for that matter. dont luisten to the retards, just liste to who u know is telling the truth.

First of all, call the cops and report that your son has been kidnapped. It doesn't matter if it's his dad or if he went with him with your permission. If you have legal custody and anyone takes him without permission or longer than they are supposed to, it is kidnapping. Secondly, If your son's father is on parole and has your son and he has not paid child support, he will go back to jail. More than likely if he has just got out of jail he will not gain custody of your son unless they find he can give him a better life than you, which doesn't seem likely. Third off, don't put your son in the middle of a legal battle. Shield him from as much adult crap as you can. If you don't, your son will throw it in your face later.

I don't know for sure, but I think he can. Violating child support is contempt of court, which is a crime. If I'm not mistaken, isn't any violation of any law a direct violation of parole, which would cause the parole to be revoked?

Best thing would be to ask a lawyer.

Call the police.

If he was supposed to have your son back by a certain day then he can be charged with kidnapping. If not I am sure you can get him for the child support.
