Ok a cop is giving a motorist a ticket, now down the street there is 3 people that are drunk getting in a car. The cop sees the 3 people. Should the cop continue giving the ticket, or go after the 3 people getting in the car? And if he doesn't go after the 3 people what disiplinary action should be taken against the police officer....???

gee phil its something I just witnessed. You sure asume and sound like a bitter police officer that likes to send people to jail. And furthermore I believe down the street means 1 block to be exact. If you cannot see that far hum. I just figured police know a drug suspect just passing a car the opposite direction so I figured you could sense a drunk driver by looking whats the difference. Plus I really don't know to many police officers that send people to jail for traffic tickets to often. LIGHTEN UP GROUCH

It will depend alot on police agency policy.

Option one, finish the ticket latter and mail it to the person, it can be done if needed.

Order the person who you are writing the ticket to remain in place , hold on to his license and make him wait.

Let him go and go get the other driver.

But you have a few issues on the "drunk" people.
Thier mere action before getting into the car is not proof of being drunk and not reasonable suspesion to do a traffic stop.
You will have to follow the car and see if you can find a reason to stop them. And after stopping them, unless you have enough evidence to make them to a soberity test you still can't.

There is a list of indicators and you have to have a certain point value to have a legal reason to stop them, if you don't , then even if they blow high, the case will never be heard in court.

Sorry but with the laws on DUI, just seeing a drunk walking and getting into a car does not allow you to stop them and site them.

Depending on the traffic ticket. If its speed related or a minor moving violation then count your blessings your not going to get the ticket. However if its a more serious ticket the officer can either call for another officer to pick up the DUI suspects or tell the driver getting the ticket to stay put. If that was the case and the driver getting the ticket left, then he/she can be arrested for disobeing a lawful order. In the end its up to the officer
If the people in the second car are drunk and the officer does nothing, the disiplinary action would depend on if the dui suspects were involved in a crash or something of that nature

How in the world would / could anyone, from "down the street" know if 3 people getting into a car are drunk? Was a drunk getting behind the wheel, or simply getting in a passenger seat? Cops are not all knowing.
Theres more than one way of taking care of this: such as holding on to the original violators information, & going to deal with the supposed problem at hand (means you get to wait) - so you still dont get a get outta jail free pass.

Technically speaking, there is no charge that can be leveled against the officer. However, morally he should take the time to stop the people getting into the vehicle and administer a field sobriety test. Simpy getting behind the wheel of a car when you are drunk is a DWI even if you haven't started the car. You had the intention of driving it that way. The cop could finish the ticket, but make a call informing another officer of the situation so that they can take care of it.

Depends on what the ticket is about, if it was a minor violation, the cop would probably quickly give the ticket and then go after the 3 drunks. Either way, the cop should radio in the situation. Also, the cop will go after which situation looks more dangerous.

I'm with Phil. How can you tell from down the street that 3 people are drunk? THAT seems to be overstepping some cop boundaries to me.

Nope, can't go there. That's the officer's choice. His superiors will decide if he's a good officer not the person getting the ticket.

how can you tell the other people were drunk if they are down the street. there are too many variables in this story.
