We are currently on work visa (H1) and are here in US from the last 3 yrs. Still haven't applied for GC

There is no way around the long wait whether you petition through family, employment, DV lottery, or asylum. Everyone has to get in line. The fastest way is through marriage to a US citizen, and that generally takes about 10 to 12 months.

If you are on an H visa right now, it is imperative that you begin the green card process. You can only be in the US for six years on an H (unless you have a labor cert or immigrant petition pending for at least 365 days). Currently there is an immigrant visa backlog which could mean you might not even make the cut for green card applications when your sixth year expires. My advise is to move quickly if your H sponsor is willing to assist in the green card process.

Sorry, but the green card process is no fun. Naturalisation is actually far less tedious & drawn out, by comparison.

But if you've been here on an H1 visa for 3 years already, don't you only have 2 years left ? If so, you better apply soon, because it WILL take an age to get the green card.

Short answer is "No!" In your case you can either get a GC thru a an employer based petetion or a family based petition. Either filing type has it's own set of rules and procedures and take at least 1-year, depending on the complexity of your filing. You can always enter the DV lottery but that is you agst 6 million other entrants so...it's safe to safe that it is a long shot.

Unfortunately no. The U.S. government does not allow people to immigrate here easily. Even if you were an American citizen and had a child oversease that was not a citizen, if you wanted to bring them here, you would have to wait months or years and pay thousands of dollars just to get them here. That's if the BCIS does not make any mistakes, and they usually do screw something up and use it as an excuse to kick you out of the country.
