You first have to figure out who has jurisdiction. It is usually where the incident took place. You have to go to the court, fill out a complaint and pay a filing fee. The clerk sends the complaint to the defendant. A trial date is set. You appear and present your case to the judge.

Go to the municipal or county court, or civic center in your community. They should have an office where you can file a small claims suit for a nominal charge, and a court date will be set. Understand that filing a small claims petition does not entitle you to an attorney to represent you. You're strictly on your own to try and convince the judge of your case. If this involves a money matter, there is a limit to how much restitution you're entitled to in small claims matters. Where I live, it is $5,000, but this amount can vary according to where you live. If it is over the limited amount, your case will be referred to a higher court for a civil trial, in which case you then can have an attorney present. Good luck!
