Choosing jail time (even if it's only 10 days) over 12 months probation on a misdemeanor is a very unintelligent decision. The shortest probation time I've ever heard of on any misdemeanor is 3 years, so be grateful and take it. Obviously you've never served any jail sentence or you wouldn't be considering it as a good trade-off. You should never want to be in jail.

If you wish to work out a plea agreement with the DA before the trial, you can do that normally if they will.
If you are on 12 month probation and violate the probation, you go to jail for the remainder of the 12 months

the judge probably dont care if you want jail time or probation. You was assessed probation as a punishment. If you wish to have jail time instead, just violate your conditions of your probation, (fail to show up for a report, fail to pay court cost, probation fees, etc.) this should get you revocated and you will get to spend the entire amount of time you were given in the county pokey.

read your sentencing paperwork. it will usually state something like "30 days in jail suspended to 12 mo. probation"
