My friend bought a brand new house three months ago. She lives on that house with her fiance. It is a two story house. Since she moved in she is having problems with the first floor restroom. The toliet is not flushong properly and they have to use the pump to have everything flushed. Yesterday when the woke up in the morning she found a all the floor full of water (flooding). She called the builder (becuase that house has one year warranty) and they sent a supervisor and a plumber and the said that they have to take the walls and the kitchen down and dig on the floor to fix the tank pumps and it will cost $3000 also they told her that they will put a camera to go into the septic tank and if it is full of tissue paper the warrranty will nto cover that. I told her that is bullsh..!, how come in three months you are going to have your septic tank full of tissue paper. She lives in Florida. I want to help her. Need legal advice and HELP!! What she can do??

The first thing to do is to read the sales agreement and warranties that should have been provided at closing. It if doesn't mention anything regarding the septic tank, tank pump and what not to flush down the toilet, then it should be the developer's/builder's responsibility to fix the construction defects.

A septic tank inspection is not covered under a 'normal' New Home Inspection and is treated differently. There are Septic tank inspectors which are normally used on houses that are not a new development unit.

Florida laws could differ from other states, but home-buyer rights are covered under some federal regulations and apply to all types of developments. The most important thing is to read the closing documents regarding the purchase and if there is a Mortgage, the appraiser could have been an inspector.

The builder is responsible for that. The builder is responsible for everything for the life of the warranty. Septic tanks don't fill up that quickly. Also in the future they should use the enzyme stuff for septic tanks...helps breakdown stuffs in the septic tank.

Hell our builder covered some things well after the warranty was up....somethings were caused by poor workmanship.

it doesn't sound like it is brand new if the septic tank is full of tissue paper. didn't they get a home inspection before they purchased the house. maybe they can get that stuff called RidX and why can't the plumber rod the lines to the tank before they rip out the kitchen.

The liability should be clear--when she closed on the house, following an inspection (which sounds like it didn't include a close inspection of the septic tank), it is hers, warts and all.

unless there was a stipulation in the sales agreement (not likely), she will have to pay.

home ownership can be stressful, she is discovering sooner than most!
